The undersigned (“Releasor”) acknowledges that participation in personal training with Kotconn Fitness (“Kotconn”) is a strenuous activity which is beyond the capability of some people, and may cause minor, severe and/or permanent injuries or death. Releasor agrees on behalf himself/herself to participate in such training. Releasor recognizes that Kotconn has not evaluated my ability to participate in such training, nor will Kotconn do so at any time during Releasor’s participation. Releasor also recognizes that any advice dispensed by Kotconn, is employees, agent, directors of officers may not be appropriate for Releasor, and it is Releasor’s responsibility to make this determination.
Releasor acknowledges that Kotconn’s training is an extreme test of a person’s physical and mental limits and carries with it, regardless of physical fitness or experience, the potential for death, serious injury and property loss. Releasor hereby assumes the risks of participating in such training and certifies that his/her level of physical fitness is appropriate to participate in the personal training which Releasor is voluntarily undertaking. Releasor certifies that he/she has sufficiently trained or prepared for such training and that Releasor has not been advised against participation in such activity by a qualified health care professional.
Rleasor, for himself/herself, his/her past, present and future agents, attorneys, representatives, predecessor, successors, assigns, heirs and executors to fully and forever waive, release, discharge, indemnify and hold harmless Kotconn, its past, present and future members, officers, agents, representatives, contractors, attorneys, employees, successors and assigns (collectively “Releasees”) from any and all matter of liability, claims for damages, causes of action, suits, proceedings, compensation, attorney’s fees, costs and expenses of suits, claims and demands whatsoever, which may arise from Releasor’s participation in Kotconn’s training, including, but not limited to, any and all claims, losses or liabilities for death, personal injury, partial or permanent disability, property damage, medical or hospital bills, theft or damage of any kind, including economic losses, which may arise out of or relate to Releasor’s participation in Kotconn’s training.
Releasor acknowledges that there may be motor vehicles, cycles (motor-driven or otherwise), persons (whether on foot, cycle or otherwise), dangerous or adverse road/trail/route or water conditions, road/trail/route or water hazards, water-craft, obstacles or other objects present in water, wildlife, marine life or other animals present during Kotconn’s training, and Releasor hereby assumes the risk related thereto. Releasor hereby assumes any and all other risks associated with participating in Kotconn’s training, including, but not limited to contact or effects of other participants and effects of weather.
Releasor grants to Kotconn permission to use Releasor’s name and/or likeness for its business operations, including, but not limited to use in video demonstrations, advertisements, training materials and promotional usage. Releasor waives all rights to any future compensation to which Releasor may otherwise be entitled as a result of the use of his/her name of likeness.
